Com a promulgação do decreto presidencial 11.092/2022, entrou em vigor 09/06/2022 o Protocolo sobre Regras Comerciais e de Transparência Brasil-EUA, assinado em 19 de outubro de 2020. Trata-se de pacote comercial ambicioso e moderno, que visa à promoção dos fluxos bilaterais de comércio e investimento.
O instrumento conta com anexos sobre: i) Facilitação de Comércio e Administração Aduaneira; ii) Boas Práticas Regulatórias e iii) Anticorrupção.
O Protocolo viabilizará diminuição da burocracia de comércio exterior; redução do custo de operações de importação e exportação; e adoção de boas práticas no campo regulatório.
O anexo sobre facilitação de comércio é o texto mais avançado negociado nessa área pelo Brasil, indo além, em diversos aspectos, do Acordo sobre Facilitação de Comércio (AFC) da OMC. O anexo a respeito de boas práticas regulatórias representa o primeiro acordo com cláusulas vinculantes já adotado pelo Brasil. O anexo anticorrupção reitera, bilateralmente, obrigações legislativas a que os dois países se comprometeram no âmbito multilateral.
Ao modernizar as regras que regem o intercâmbio comercial do Brasil com seu segundo maior parceiro comercial, a plena produção de efeitos do Protocolo atende a reivindicações do setor privado dos dois países. A adoção do instrumento ilustra o potencial da parceria entre o Brasil e os EUA.

With the enactment of Presidential Decree 11.092/2022, the Brazil-US Protocol on Trade and Transparency Rules, signed on October 19, 2020, entered into force on 06/09/2022. It is an ambitious and modern trade package aimed at promoting bilateral trade and investment flows.
The instrument has annexes on: i) Trade Facilitation and Customs Administration; ii) Good Regulatory Practices and iii) Anti-Corruption.
The Protocol will make it possible to reduce the bureaucracy of foreign trade; reduce the cost of import and export operations; and adopt good practices in the regulatory field.
The annex on trade facilitation is the most advanced text negotiated by Brazil in this area, going beyond, in several aspects, the WTO Agreement on Trade Facilitation (AFC). The annex on good regulatory practices represents the first agreement with binding clauses ever adopted by Brazil. The anti-corruption annex reiterates, bilaterally, legislative obligations to which both countries have committed at the multilateral level.
By modernizing the rules that govern Brazil’s commercial exchange with its second largest trading partner, the Protocol’s full effect meets the demands of the private sector in both countries. The adoption of the instrument illustrates the potential of the partnership between Brazil and the USA.
